UH, THOSE HAVE BEEN PROGRAMMED AND DISTRIBUTED TO, UH, THE DEPARTMENTS IN THE COUNTY THAT, UM, NEED THOSE RADIOS.
THAT'S WHY WE'RE ABLE TO, IN THE PREVIOUS ITEM, UH, SURPLUS, THOSE RADIOS.
UM, WE ARE WORKING WITH THE SHERIFF'S OFFICE TO GET, UH, THE REST OF THE RADIOS DEPLOYED, UH, PROGRAMMED AND DEPLOYED.
UH, WE ARE WORKING, UM, ON THE BROCK TOWER.
UM, WE WILL PROBABLY SEE SOME MOVEMENT OF DIRT THERE WITHIN THE NEXT QUARTER.

REVIEW AND DISCUSS THE COST OF LINEAR FOOTAGE ERODES TO BE USED IN THE FORMULA FOR CONSTRUCTION, MAINTENANCE, LETTERS OF CREDIT, AND TAKE ANY ACTION IN THE COURT DEEMS NECESSARY.UH, COMMISSIONER HOLT, IF YOU WOULD OPEN THIS ITEM AND SURE.
SO PRECINCT TWO CURRENTLY HAS A COUPLE OF ROAD PROJECTS WHERE A DEVELOPER DID NOT PERFORM TO STANDARDS.
UM, THE LETTER OF CREDIT THAT WAS POSTED IS BASED OFF OF A CONSTRUCTION COST RATE.
THAT'S FROM I THINK 2012, MAYBE 2011.
AND SO I BELIEVE THE RATE USED IS $35 PER FOOT.
UM, CURRENT RATES THAT I'VE RECEIVED FROM ROAD VENDORS ARE ANYWHERE BETWEEN 85 AND $105 PER FOOT, DEPENDING ON WHAT TYPE OF ROAD OR WHAT TYPE OF, UH, MATERIAL AND CONSTRUCTION IS PERFORMED.
SO THE, THE PURPOSE HERE IS JUST TO REVIEW AND DISCUSS THAT COST.

VERY SIMPLE FORMULA WHERE WE PLUG IN A NUMBER AND WE CAN ADJUST THAT NUMBER.AND THE, THE BASIC ISSUE HERE IS WHO PICKS UP THE COST IF A DEVELOPER FAILS TO PERFORM TO NECESSARY STANDARDS.
AND AS BEST I CAN TELL, TAXPAYERS DO, AND I DON'T PARTICULARLY LIKE THAT.
SO MY SUGGESTION IS TO DISCUSS UPDATING IT TO AT LEAST $85 PER LINEAR FOOT TODAY.

SO WHEN WE WENT OUT FOR, UM, UPDATED INFORMATION FROM VARIOUS LOCAL ROAD CONSTRUCTION COMPANIES THAT DO A SIGNIFICANT AMOUNT OF WORK HERE IN PARKER COUNTY, THAT INCLUDES TRACY DOBBS, UH, 4K, JAMIE JENNINGS, ET CETERA.
I THINK YOU GUYS WILL BE FAMILIAR WITH THOSE NAMES.
UH, THEY GAVE US RATES BETWEEN 85 FOR CHIP SEAL TWO COURSE CHIP SEAL PER OUR SUBDIVISION REGULATIONS UP TO 109.5 PER LINEAR FOOT FOR HOT MIX.
AND THEN THE OTHER QUOTES WERE FOR 85 AND 100.
AND SO I THINK IT'S APPROPRIATE FOR US TO DISCUSS AND REVIEW INCREASING THAT AMOUNT.
I'VE, I'VE DISCUSSED THIS WITH, UH, SOME BANKERS AND I'M, I'M CERTAINLY NOT A BANKER, BUT MY UNDERSTANDING IS THAT IF WE INCREASE THIS AND THEY HAVE TO GO GET A BETTER, THE DEVELOPER HAS TO GET A BIGGER LETTER OF CREDIT.
IT DOESN'T ACTUALLY COST THE DEVELOPER REAL DOLLARS IN REAL TIME UNLESS THAT LETTER OF CREDIT IS ACTUALLY CALLED NOW.
WE CAN DISCUSS GOING TO A BOND.
MY UNDERSTANDING IS THAT THE PRO OF GOING TO A BOND IS THAT THE REVIEW PROCESS IS A LOT MORE THOROUGH FOR THE BOND TO GET POSTED.
THE CON TO GOING TO A BOND IS, IT'S A LOT MORE DIFFICULT TO GET THAT CALLED AND IT'S A LOT MORE DIFFICULT TO WORK WITH.
SO I THINK, I THINK BOTH ASPECTS SHOULD BE DISCUSSED.
WELL, IF THE DEVELOPERS WILL DO THEIR JOB CORRECTLY, THEY'LL THEY'LL GET THEIR BOND BACK.
I MEAN, THEY'LL JUST DO THEIR JOB CORRECTLY.
THEY'RE NOT GOING TO PAY ANY MORE MONEY.
SO COMMISSIONER, THE, UH, THE, THE NUMBERS THAT YOU QUOTED ARE, ARE THOSE FOR COMPLETE CONSTRUCTION OF A ROAD? CORRECT.
AND ARE YOU GONNA BE IN A SITUATION, THE, THE SITUATION YOU DESCRIBED WHERE YOU'RE GOING TO HAVE TO COMPLETELY CONSTRUCT THE ROAD? IF SO, SO AS FAR AS PUTTING IN NEW BASE, ET CETERA, I DON'T KNOW CUZ I, I YOU WOULD HAVE TO DESCRIBE THE SITUATION TO ME FIRST.
HOWEVER, THERE IS AN ISSUE WHERE YOU COULD GO IN AND HAVE TO EXCAVATE AND HAUL OFF AND HAVE SIGNIFICANT COSTS THERE.
I DO THINK IT'S WORTH POINTING OUT THAT WE CAN'T PROFIT OFF OF THIS.
SO LET'S SAY THAT WE COST SOMEONE TO PUT UP A LETTER OF CREDIT FOR, I'LL USE EASY MATH A HUNDRED THOUSAND DOLLARS, BUT IT ONLY TAKES US $30,000 TO GET THE JOB DONE.
THE COUNTY'S NOT POCKETING THAT $70,000 AND THE DEVELOPER'S NOT OUT THAT $70,000.
IT'S, IT'S THE ONLY MONEY THAT'S USED HERE IS THE MONEY THAT'S NECESSARY.
SO I GUESS I'LL, I'LL, I'VE NEVER HAD THAT SITUATION BECAUSE, UH, IN MY PRECINCT, WE, UH, WE INSPECT THOSE ROADWAYS, UH, AT LEAST THREE TIMES, SEVERAL TIMES MORE THAN THAT.
AND WE REQUIRE THEM TO, UH, PROVIDE US WITH THE DOCUMENTATION THAT THEY HAVE FOLLOWED THE USED, THE CORRECT MATERIALS THAT THEY'VE USED, UH, THE ROADWAY BASE THAT THEY'RE SUPPOSED TO BE USING.
AND, AND, UH, I'VE NEVER HAD THAT SITUATION COME UP, IS THE REASON I'M SAYING IT HAPPENS.
WE'VE SEEN IT IN PRECINCT TOO, BUT WE INSPECT WHEN THE, THE ROUGH WORK IS DONE IN THE DRAINAGE AND WE INSPECT WHEN THERE IS, UH, EIGHT INCHES OF COMPACTED BASE AND THEN WE INSPECT PRIOR TO, UH, EITHER THE CHIP SEAL OR THE HOT MIX PAVING.
SO WE'RE THERE EACH STEP OF THE WAY SO WE, WE KNOW THAT, UH, THAT WORK IS BEING DONE.
UM, AND THAT'S THE WAY WE HANDLE IT.
SO THERE'S NEVER BEEN A SITUATION IN MY PRECINCT WHERE WE'VE HAD TO CALL A BOND.
WE'VE HAD TO, UH, UH, DO IT ON SOME MAINTENANCE, UH, THREATENED TO A TIME OR TWO BECAUSE THEY DIDN'T DO THE MAINTENANCE, UH, THAT THEY SHOULD.
BUT I'VE NEVER HAD TO FULLY CONSTRUCT A ROAD BECAUSE WE, WE DO THE,

UH, INSPECTION PROCESS AS WE GO ALONG.AND SO THEREFORE, ONE OF THE PROBLEMS THAT I FORESEE HERE, THE PROBLEM THAT WE HAVE NOW IS, UH, PRIVATE ROADS AND, UH, RATHER THAN PUT UP THE BOND OR PUT UP THAT THAT MONEY, UH, THE DEVELOPER JUST COMES IN THEN AND SAYS, WELL, WE'LL JUST DO PRIVATE ROADS AND THE HOA WILL TAKE CARE OF THAT SITUATION, WHICH LEADS US TO MUCH BIGGER PROBLEMS DOWN THE ROAD.
NOW, IT HASN'T BEEN UPDATED IN A LONG TIME, BUT MY POINT IN THIS IS THAT WE'RE NOT GOING TO BE, UH, TRYING TO COLLECT ENOUGH MONEY TO, AND A BOND TO COMPLETELY BUILD A ROAD THAT SHOULD SITUATION SHOULD NEVER OCCUR.
I'VE CALLED TWO BONDS, BUT IT WAS JUST RE RE PAVE THE ROAD, YOU KNOW? RIGHT.
WE DON'T, WE DIDN'T HAVE THAT SEAL IT OR REP PAVE IT, GOTTA RED CHIP SEAL.
AND I'VE GOT MORE THAT NEED TO BE RECHIS SEALED THAN, BUT THE DEVELOPERS ARE DOING THAT.
BUT WE SHOULD NEVER HAVE TO REDO A WHOLE ROAD.
BUT JOHN, YOU'VE BEEN HERE LONGER THAN US.
DID DO YOU WERE, COULD A SITUATION ARISE WHERE, UM, A UH, SUBDIVISION HAS PLATTED BUT NO ROAD IS EVER BUILT AND WE WOULD HAVE TO COMPLETELY BUILD THE ENTIRE ROAD? WE, THE ONLY TIME WE'VE EVER HAD THAT, WE HAD THAT ONCE AND WE WERE ABLE TO WORK WITH THE, UM, ALL THEY DID WAS PAVE IT.
THAT THAT WAS IN PRECINCT TOO.
AND WHAT THEY DID, THEY DID EVERYTHING EXCEPT TO PAVE THAT ROAD AND, AND THEY CAME BACK AND PAVED IT.
AND WE WORKED, WE WORKED WITH THE THIRD PARTY MM-HMM.
UH, THERE WAS A CONTRACTOR THAT WE LINED THEM UP TO RELEASE THE BOND DIRECTLY TO THAT THIRD PARTY.
AND SO WE WERE PRETTY MUCH A MIDDLEMAN IN THAT PROCESS.
THEY AGREED TO A CERTAIN RATE BASED ON WHAT THE BOND WAS AVAILABLE, THAT THAT'S THE ONE TIME WE WORKED WITH THEM.
AND, AND THIS, THIS DIDN'T, UH, MATERIALIZE OUT OF, UH, OUT OF NOWHERE.
WE HAVE TWO PROJECTS RIGHT NOW WHERE THE TAXPAYER'S GOING TO BE PAYING THE NET DIFFERENCE BETWEEN WHATEVER THE COST ENDS UP BEING, BUT WE ARE AWARE THAT THE BOND OR THE LETTER OF CREDIT AMOUNT IS INSUFFICIENT TO COVER WHAT THE, UM, WHAT THE PROJECT IS GONNA COST.
AND SO, WELL I AGREE WE NEED, I'LL FIND NUMBERS ON THAT.
WE NEED TO RAISE THE PRICE, BUT MAYBE NOT UP TO 85.
ONE OTHER POINT THAT I'D LIKE TO MAKE, UH, UM, THE, UH, DEVELOPERS THAT I'VE SPOKEN WITH, YOU KNOW, THEY EITHER PUT UP A, A CASH BOND, CASHIERS CHECK OR, UH, THE LETTER OF CREDIT.
AND, UH, THE DEVELOPERS THAT I'VE TALKED TO TELL ME THAT THEY HAVE TO PAY POINTS, THEY HAVE TO PAY INTEREST ON THAT LETTER OF CREDIT WHILE IT'S OUT THERE.
